NOTICE OF RIGHT TO OPT-OUT OF SALE OR SHARING OF PERSONAL INFORMATION AND LIMIT THE USE OR DISCLOSURE OF SENSITIVE PERSONAL INFORMATION
This NOTICE OF RIGHT TO OPT-OUT OF SALE OR SHARING OF PERSONAL INFORMATION AND LIMIT THE USE OR DISCLOSURE OF SENSITIVE PERSONAL INFORMATION (“OPT-OUT NOTICE”) is provided to inform residents of California and Virginia of their right to direct Nissan North America, Inc. (“Nissan” or “we”) to restrict certain uses of residents’ personal information, including sensitive personal information.
In reviewing this Opt-Out Notice, you also may want to review the Nissan Privacy Notice, which describes our privacy policy, including with respect to the sale, sharing, use and disclosure of your information. This Opt-Out Notice applies to individuals who reside in the State of California or the Commonwealth of Virginia and whose personal information Nissan sells or shares or, with regard to California, whose sensitive personal information Nissan uses or discloses (“consumers” or “you”).
Specific Information for California Residents
Nissan is providing resident of the State of California with this Opt-Out Notice to comply with the California Privacy Rights Act of 2020 (“CPRA”) (which amended the California Consumer Privacy Act), and other California privacy laws. Any terms defined in the CPRA have the same meaning when used in this Opt-Out Notice.
Under the CPRA, California consumers have the right to direct businesses not to sell or share their personal information if the businesses otherwise would. This is known as the “right to opt-out.” California consumers also may limit the use or disclosure by Nissan of Sensitive Personal Information, which includes (i) identifying numbers like Social Security, driver’s license, or passport number, (ii) account log-in, financial account, debit card, or credit card number when combined with a security or access code, password, or other credentials, (iii) precise geolocation, (iv) racial or ethnic origin, religious or philosophical beliefs, or union membership, (v) contents of a consumer’s mail, email, and text messages unless Nissan is the intended recipient of the communication, (vi) genetic data, (vii) biometric information used to identify a consumer, (viii) health information, and (ix) information regarding a consumer’s sex life or sexual orientation. “Sensitive Personal Information” does not include publicly available information.
Specific Information for Virginia Residents
Nissan is providing residents of the Commonwealth of Virginia with this Opt-Out Notice to comply with Virginia’s Consumer Data Protection Act of 2021 (“CDPA”). Any terms defined in the CDPA have the same meaning when used in this Opt-Out Notice.
Under the CDPA, Virginia residents have the right to direct businesses not to process their personal data for purposes of (i) targeted advertising, (ii) sale, or (iii) profiling in furtherance of decisions that produce legal or similarly significant effects concerning the consumer. This is known as the “right to opt-out.”

Proof Required to Opt-Out
In order to exercise your rights under the CPRA or CDPA, Nissan is required to verify your identity - in other words, we need to know that you are who you say you are. This is to keep others from exercising your rights without your permission. In order to complete your opt-out, you will need to provide information to prove your identity, such as:
